At the session, experts will have a discussion on improving the mechanisms of cross-border dispute resolutions as one of the most important conditions for enhancing the investment attractiveness of the BRICS region.  The panelists will consider the issues of the functioning of the alternative system of private-law disputes resolution, such as development of the international commercial arbitration within the BRICS and increasing the international prestige of significant arbitration institutions of the region. The experts will give particular attention to the organisation of an interstate legal assistance in the BRICS countries and mutual recognition and enforcement of foreign arbitral awards.

Actual problems of international economic cooperation have always been one of the key topics of the previous BRICS legal forums. A substantial extension of international influence of “the five” and transformation of the BRICS into the main element of the world economy have increased the need in creating new general or similar conditions of conduct of business, reducing or eliminating legal barriers for economic interaction within the BRICS. During the session, the matter of discussion between experts will be legal support of cross-border trade of the BRICS countries at the macro and micro levels, coordination of tax and customs policy, balance of taxation systems of the member states, joint countering tax evasion, combatting corruption and counterfeiting.

At the panel session, the participants are encouraged to discuss the problems of stability of constitutional order in modern geopolitical conditions, legal aspects of state sovereignty and territorial integrity of the BRICS member states, as well as legal instruments and mechanisms ensuring national security. The 4th BRICS Legal Forum focuses on formation of an equitable global legal order within the BRICS through interaction between legal systems of the member states. In many respects, this particular subject determines the topics to be presented by speakers of the plenary session, in the course of which the attention will be directed to the significant spheres of legal cooperation of the BRICS countries, as this cooperation is an important instrument of transformation of the BRICS into a mechanism of strategic and current interaction on key issues of global politics and economics. The plenary discussion will set the directions of the further work of the sessions of the Forum in order to determine actual forms, principles and prospects of the legal cooperation among the BRICS member states.
