The recent expansion of BRICS and the growing number of applications
for membership from various states testify to the attractiveness of the BRICS model of international cooperation based on mutual respect and equal dialogue.The BRICS member States are in favour of building a fair and stable world order, which, in turn, implies strict adherence to the rule of law in international relations. Undoubtedly, the achievement of these goals is impossible without an active stance
of legal communities of the BRICS.The 9th BRICS Legal Forum is a platform where legal scientists and practitioners seek to find effective legal solutions to the issues that are on the BRICS interaction agenda.During the plenary session, the Forum focus areas will be defined in order to further develop and strengthen cooperation of the BRICS member States on legal issues.

Legal Education and Science in BRICS: National Traditions and Universal Practices

Training qualified legal personnel is one of the priority tasks facing the legal communities of the BRICS member States. In the course of discussion, it is proposed to consider organisation of legal education in the countries of the association, as well as promising areas of cooperation among the BRICS member States in the field of legal education and science.

In legal education, how do the BRICS countries combine national specificity with the need to train lawyers capable of working in foreign markets or internationally? What are the most optimal timing and forms of organising higher legal education in the BRICS countries? What are the prospects for an effective mechanism aimed at simplifying recognition of higher education diplomas and the awarding of degrees within the association? How necessary is the development of digital competences and the application of interdisciplinary approaches in higher legal education in the countries of the association? What steps should be taken for more dynamic development of networking and academic mobility among research and educational organisations of the BRICS countries? Is there a prospect for creating a common educational space in BRICS?

As a result of the session, it is proposed to come up with recommendations aimed at intensifying and expanding cooperation among educational and research organisations from the countries of the association.

Active integration processes observed in the BRICS area are inextricably linked to the digital infrastructure development of the BRICS member States. The digital cooperation is one of central and most relevant agendas within BRICS. At the same time, it is now evident that, at the legal level, the issues of cooperation and digital security require in-depth exploration and the adoption of measures that will help reduce the impact of external negative aspects and ensure effectiveness of the implemented solutions.

Generally, the approaches of the supreme courts shape legal opinions on the interpretation of laws, and the role of judges is to ensure fairness and the rule of law. The effectiveness of the legal system directly depends on an effective judiciary.

What is the role of national courts in the protection of human rights and freedoms? How are the rights and legitimate interests of commercial organisations protected in the BRICS countries? What possible formats of interaction exist between the supreme courts of the BRICS countries? One of the priorities of the Russian Federation’s chairmanship in BRICS in 2024
is cooperation in the humanitarian and cultural spheres. It is proposed to discuss the draft memorandum of understanding on humanitarian development of the BRICS countries and its implementation plan as part of the session. In the context of sanctions and a multipolar world, the development of a competitiveness in the digital economy is relevant, when adjusting strategies and programs for innovative development through the intellectual property market. Realising the potential of intellectual property requires an effective legal regulation

Transforming International Justice Institutions to Support a Fair World Order: Role of BRICS

As is known, international justice is the activity of international judicial bodies to resolve disputes based on international law. However, many of the existing international justice mechanisms are unfortunately losing their quality as impartial means of resolving international disputes. With an unprecedented increase of geopolitical risks in the world, there is a growing realisation that the old global architecture is being replaced by a new configuration of international relations and regional blocs. At the same time, the role and influence of BRICS is growing enormously, as its partnership is built on equality, respect for the sovereignty and interests of all member states.

BRICS featuring two of the five permanent members of the UN Security Council and the accession of states from different regions of the world makes this association significant for a fair universal international world order. This raises the question of the practicality of establishing new independent mechanisms of international justice within BRICS that can successfully counter the current politically biased mechanisms of international justice.

This session aims to bring together academics studying international justice issues and the BRICS legal status, as well as practitioners with experience in these fields to discuss further development of international judicial bodies and the BRICS role in the development of fair international justice.

At present, the architecture of international trade is undergoing significant structural changes, which in turn leads to a significant renewal of its legal arrangement.
Of course, the BRICS countries are active participants in these processes, engaged both at the level of their national legislation and through international cooperation

The trend towards globalisation in the world is in a sense being replaced by the trend towards sustainable development. The concept of sustainable development could be a balancer to stabilise the international economic, eco-climatic and social agenda. With insufficient international legal regulation, conflicting understandings of basic institutions, as well as ratings and metrics, states are in search of national and regional priorities and models of sustainable development. The process of harmonisation within regional and integration unions and associations becomes especially relevant in this regard. For the BRICS countries, the sustainable development agenda is of significant interest due to the notable amount of resources, industrial output and technology.

The key instrument for this agenda can and should be law – sustainable development law. What legal projects are being implemented in the BRICS countries? What are the standards and principles of sustainable development? What are the prospects for harmonising the BRICS legislation? What joint projects and initiatives could be most effective? Today, we could confidently state a certain transformation of approaches to legal regulation. There are at least two distinct aspects to this trend. BRICS Legal Space: In Search of New Forms of Legal System Interaction

Harmonisation, unification, and integration are well-known forms of convergence in international law. However, BRICS, being a unique form of international cooperation, requires a new look at the problem of the interaction of legal systems and the ways to find common legal solutions to certain issues arising within the association.

The BRICS legal space combines, on the one hand, the recognition of the diversity of national approaches to legal regulation based on the sovereign equality of States, and on the other hand, member States’ desire to find common approaches to legal regulation, including those within the framework of multilateral BRICS cooperation.

The session will focus on discussing new forms of legal systems interaction within the BRICS space and evaluating their potential compared to traditional convergence mechanisms used in international organisations and integration associations.
